General Terms and Conditions (GT&C)
1. Provider and Scope of Application
The provider and contractual partner for all deliveries, services and offers is MONO Drinks AG, Binzstrasse 23, 8045 Zurich.
These GT&C apply to all orders and deliveries within Switzerland and the Principality of Liechtenstein via the website www.gripenshot.ch / www.monojuice.ch ("Website"). By placing an order, you accept these GT&C in the version valid at the time of ordering. MONO Drinks AG may amend these GT&C at any time; amendments shall take effect upon publication.
2. Order and Contract Formation
Orders are placed exclusively through the online shop. By clicking the "Buy" button, you place a binding order for the items contained in the shopping cart. Receipt of your order will be confirmed to you electronically. The contract shall only be concluded when MONO Drinks AG expressly accepts the order through the automatic order confirmation. The company reserves the right to reject orders without stating reasons.
Right of withdrawal:
Please note: As these are perishable goods, there is no voluntary right of return.
Detailed information can be found in our separate withdrawal policy. Your statutory warranty rights in the event of product defects remain unaffected.
3. Delivery Conditions, Order Deadlines, Storage
Delivery area:
Deliveries are made exclusively to addresses in Switzerland and the Principality of Liechtenstein.
Place of performance & transfer of risk:
The place of performance and transfer of risk shall occur at the respective delivery location.
Shipping methods:
Parcel shipping (A-Post) or comparable.
For deliveries within the city of Zurich, we reserve the right to deliver with our own MONO bicycle courier.
Shipping days:
Orders are shipped from Monday to Thursday. Delivery therefore usually takes place from Tuesday to Friday.
Delivery:
Shipments are usually delivered on the day following the order.
Delivery on the following day requires an order on the previous day by 12:00 PM at the latest. Deliveries are generally possible on weekdays from Tuesday to Friday.
Orders received on Friday, Saturday or Sunday will be shipped on the following Monday.
A next-day delivery guarantee cannot be 100% guaranteed due to cooperation with external shipping partners.
Should delivery problems with the shipping partner result in a delayed delivery and should this circumstance constitute a substantial problem for the customer, we ask that you contact us so that we can find a suitable solution together. However, there is generally no entitlement to compensation or withdrawal, unless the delay is attributable to gross negligence on the part of MONO Drinks AG.
Public holidays/Company holidays:
No shipping or delivery takes place on public holidays or during company holidays. In this case, shipping will be postponed to the next shipping day.
Information about potential company holidays will be communicated accordingly during the purchase process.
Absence upon delivery / Returns:
Should the customer not be present at the time of delivery, the post office will deposit the shipment in accordance with its delivery regulations.
If a shipment is returned to us due to repeated delivery attempts or non-collection, additional shipping and product costs may apply for redelivery.
Storage of products after delivery:
To ensure the quality of the delivered products, the delivery must be stored in the refrigerator at a maximum of 5–8 °C on the same day after receipt. Only in this way can it be guaranteed that the freshness and quality are perfectly preserved and that the expiration date retains its full validity.
Unfortunately, we cannot accept liability for quality losses resulting from improper storage after delivery or collection.
4. Shipping Costs
Shipping costs amount to CHF 6.50 up to an order value of CHF 64.–.
From an order value of CHF 64.– onwards, we cover the shipping costs.
5. Prices and Payment
Price information:
All prices are stated in Swiss Francs (CHF) and include statutory value-added tax. The prices displayed on the website at the time of ordering shall be decisive. Shipping costs are shown separately and shall be borne by the customer up to an order value of CHF 64.–.
Price adjustments:
We reserve the right to change our prices at any time. The price displayed on the website at the time of ordering shall be decisive. Orders already placed and ongoing subscriptions remain unaffected by general price changes. However, special regulations according to Section 6 (Subscription Terms) apply to subscriptions.
Available payment methods:
– Credit card (Visa, Mastercard, American Express)
– TWINT
– Shop Pay
– Apple Pay
Payment timing:
Payment is generally made before shipping of the goods (prepayment). This means:
– For credit card, TWINT, Apple Pay: immediate charge upon order completion
– For Shop Pay: authorization upon order, charge upon shipping
The goods will only be prepared for shipping after successful payment confirmation.
Special regulations for subscriptions:
For subscriptions, the charge is made automatically at the time of renewal:
– The charge is made via your payment method stored at order completion
– You will be informed by email before the charge
– After successful charge, the order is automatically prepared for shipping
Failed payments for subscriptions:
In the event of a failed automatic charge:
1. You will be notified immediately by email.
2. You have seven days to make the payment manually or update your payment method.
3. Delivery will be suspended until payment has been successfully completed.
4. After seven days without payment receipt, the subscription will be automatically paused.
5. In the event of repeated payment failures (three times within six months), we reserve the right to cancel the subscription.
Currency conversion:
All prices and payments are made exclusively in Swiss Francs (CHF). When paying with foreign credit cards, additional fees from your bank for currency conversion may apply.
Payment security:
All payments are processed via secure, encrypted connections (SSL/TLS). We do not store complete credit card data. Payment processing is carried out by certified payment service providers (PCI-DSS compliant).
6. Subscription Terms
Availability:
Subscriptions are available for selected products and are marked accordingly in the shop.
Managing your subscription:
You manage your subscription independently via your customer account on our website. There you can at any time:
– Cancel your subscription
– Pause your subscription
– Adjust your subscription
– Reactivate your subscription
An email to us is not required for this.
Delivery frequency:
The delivery frequency depends on the subscription plan you have chosen. Details about available plans can be found when ordering.
Automatic renewal:
Your subscription renews automatically according to the selected delivery frequency. Billing is made via your stored payment method. After payment confirmation, your order is prepared for shipping.
Payment problems:
In the event of failed payment, you will be notified by email. Delivery will be suspended until payment can be successfully completed.
Cancelling, adjusting, pausing, reactivating a subscription:
Subscriptions can be cancelled, adjusted, paused or reactivated via the customer account.
Deadlines and effectiveness:
Cancellations, adjustments, pauses and reactivations of the subscription shall take effect directly until the following time:
All changes must be completed by 08:00 AM at the latest on the day of the stored order date. Changes recorded after this time can only be implemented with the next planned delivery.
You will receive an automatic email reminder 24 hours before the change deadline.
Cancellation confirmation:
In the event of cancellation, you will receive a cancellation confirmation by email with the date of the last delivery.
Price adjustments:
We reserve the right to adjust our prices at any time. Subscribers will be informed of price changes in good time by email. If no cancellation is made before the new prices take effect, the adjustment shall be deemed accepted.
Discontinuation of subscription plans:
We reserve the right to discontinue individual subscription plans or products. In this case, you will be informed by email at least 30 days before discontinuation.
You have the following options:
– Switch to a comparable subscription plan
– Continuation with adjusted delivery frequency
– Free cancellation of the subscription
Without feedback from you, your subscription will automatically be switched to the next most similar available plan.
7. Acceptance of Delivery and Obligations
Please ensure that delivery can be accepted at the specified address. After delivery, you are responsible for proper storage and refrigeration of the products. We recommend checking the goods immediately and informing us within 24 hours of incorrect deliveries or damage.
Defect notification:
Report transport damage, incorrect deliveries or quality defects within 24 hours by email to hello@gripenshot.ch.
In this case, please include the following:
– Order number
– Description of the problem
– Photos (packaging, product, label, expiration date and lot number)
After careful examination, we will offer you, if justified, a replacement, credit or refund. A return should only be made after prior agreement.
8. Products and Declarations
Product information (e.g. ingredients, allergen information, etc.) may be updated regularly. As recipe changes, etc. are possible, we ask you to check the information on the original packaging.
9. Liability
MONO Drinks AG shall be liable for damages attributable to intentional or grossly negligent conduct. For slight negligence, MONO Drinks AG shall only be liable in the event of breach of material contractual obligations.
10. Force Majeure
MONO Drinks AG shall not be liable for delivery delays or impossibility due to force majeure, including:
– Natural disasters
– Pandemics
– Strikes at suppliers or transport service providers
– Official orders
– Failure of production facilities despite proper maintenance
In the event of long-term impossibility of contract performance (> 30 days), both parties shall have an extraordinary right of termination. Payments already made will of course be refunded.
11. Data Protection
The processing of personal data is carried out in accordance with our privacy policy, which is an integral part of these GT&C.
12. Copyright
All texts, images, systems and other content on the website are subject to copyright. Any use of any kind without prior written consent of MONO Drinks AG is not permitted.
13. Severability Clause
Should individual provisions of these GT&C be or become invalid, the validity of the remaining provisions shall remain unaffected. The parties undertake to replace an invalid provision with a valid one that is as economically similar as possible.
14. Applicable Law and Jurisdiction
Swiss law shall apply exclusively, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers resident in Switzerland or the Principality of Liechtenstein, the statutory place of residence jurisdiction shall apply. For legal entities and business customers, the exclusive place of jurisdiction shall be Zurich.
